In these Terms of Service, the following definitions apply:
By creating an account, purchasing a license, or uploading Content to the Platform, you confirm that you have read, understood and agree to be bound by these Terms of Service, together with our Privacy Policy and Cookie Policy.
If you are acting on behalf of a company or legal entity, you represent that you have the authority to bind that entity to these Terms.
Users under the age of 18 are not permitted to use the Platform.
A registered account is required to purchase Content or upload Content as a Contributor. You agree to provide accurate and complete information during registration and to keep your account details up to date.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at info@bellostock.com if you become aware of any unauthorised use of your account.
Each individual or legal entity may maintain only one account. Creating multiple accounts to circumvent limitations or bans is strictly prohibited.
Access as a Contributor is granted by personal invitation only. BelloStock reserves the right to accept or refuse any application at its sole discretion and without obligation to provide reasons.
The Royalty-Free Standard License permits use of the Content for commercial and promotional purposes on any media (digital and print), subject to the following conditions:
The Extended License includes all rights of the Standard License plus the right to print the Content on physical products intended for sale, including but not limited to: canvas prints, framed art, t-shirts, mugs, calendars, notebooks and similar merchandise. Print runs are unlimited under this license.
The Extended Special License includes all rights of the Extended License plus the right to incorporate the Content into a digital product intended for resale, such as a website theme, graphic template, mobile application or commercial presentation kit. The license covers one product only. The end customers of the licensee are automatically covered for use within the purchased product.
The Editorial License permits use of the Content exclusively for editorial, journalistic, informational or documentary purposes. It does not authorise any commercial, advertising or promotional use. All editorial uses must include a visible photographer credit in the format: © [Photographer Name] / BelloStock. Failure to include this credit constitutes a material breach of the license.
All Content remains the intellectual property of the respective Contributor. BelloStock does not transfer copyright ownership to Buyers under any license tier.
All prices displayed on the Platform are in Euros (€) and inclusive of any applicable taxes where required by law. BelloStock reserves the right to modify prices at any time. Price changes do not affect licenses already purchased.
Payments are processed by PayPal. BelloStock does not store credit card or banking details on its servers. By completing a purchase, you agree to PayPal's terms and conditions.
An invoice or payment receipt is automatically issued after each completed transaction, in the format required by the Buyer's fiscal data as registered in their account. For Italian VAT-registered entities, an electronic invoice (fattura elettronica) is transmitted to the SDI system in accordance with applicable Italian law.
Due to the digital and immediately downloadable nature of the Content, all sales are final once a download link has been generated or the file has been accessed. No refunds will be issued except where required by applicable mandatory consumer protection law, or in the event of a demonstrable technical error attributable to BelloStock.
Buyers who initiate unjustified payment disputes or chargebacks through PayPal may have their accounts immediately suspended pending investigation.
Upon completion of a successful payment, a time-limited download link is generated and sent to the Buyer's registered email address. The link remains valid for 48 hours from the moment of first access. After expiry, the Buyer may generate a new download link from their account dashboard at no additional charge.
Each downloaded file includes a unique license number embedded in the filename. This number constitutes proof of license and must be retained by the Buyer.
BelloStock does not guarantee indefinite file storage. Buyers are advised to store their purchased files in a secure location promptly after download.
Contributor status is granted by personal invitation only. By accepting an invitation and completing registration, Contributors agree to these Terms in their entirety, including this Section 7.
By uploading Content to the Platform, Contributors represent and warrant that:
By uploading Content, Contributors grant BelloStock a non-exclusive, worldwide, royalty-free license to host, display, reproduce, distribute and sublicense the Content for the purposes of operating the Platform and issuing licenses to Buyers. This license remains in effect until the Content is removed by the Contributor or BelloStock.
In addition to the license described in Section 7.3, Contributors grant BelloStock a non-exclusive, worldwide, royalty-free license to use previews of their Content — with or without watermark, at BelloStock's discretion, and regardless of whether the Content has otherwise been licensed to a Buyer — for the purpose of promoting and marketing BelloStock's own business. This includes, without limitation, email newsletters, social media posts and advertising materials. Such promotional use does not constitute a sale or a commercial license to any third party, is not recorded as a sale on the Contributor's account, and does not generate any royalty or compensation for the Contributor.
Contributors are not required to grant BelloStock exclusive rights. The same Content may be distributed through other platforms and agencies simultaneously.
Contributors receive a percentage of each sale as specified in their contributor profile. The default royalty rate is 40% of the net sale amount. Royalty rates may be adjusted individually by BelloStock at any time with prior notice. Royalties are credited to the Contributor's account balance upon each completed sale.
Payouts are processed via PayPal upon request by the Contributor, provided the account balance meets the minimum threshold of €25.00. BelloStock processes payout requests promptly. BelloStock is not responsible for delays attributable to PayPal or currency conversion. Contributors are solely responsible for declaring and paying all applicable taxes on royalty income in their country of residence.
All uploaded Content is subject to review and approval by BelloStock before publication. BelloStock reserves the right to reject or remove Content at any time and without obligation to provide reasons beyond the three standard categories communicated to Contributors.
Contributors are solely responsible for the Content they upload. BelloStock accepts no liability for any claim arising from Content uploaded by Contributors, including but not limited to claims of copyright infringement, privacy violation or defamation. Contributors agree to indemnify BelloStock against any such claims in accordance with Section 11.
The following uses of the Platform are strictly prohibited:
The BelloStock name, logo, design, software, and all Platform elements (excluding Content uploaded by Contributors) are the exclusive property of Fotograv di Antonio Gravante and are protected by applicable intellectual property laws. No rights to these elements are granted to Users by these Terms.
All Content uploaded by Contributors remains the intellectual property of the respective author. BelloStock acts as a licensing intermediary and does not claim ownership of any Content.
To the maximum extent permitted by applicable law, BelloStock shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of or inability to use the Platform, including but not limited to loss of revenue, loss of data, or business interruption.
BelloStock's total aggregate liability for any claim arising from these Terms or your use of the Platform shall not exceed the amount paid by you to BelloStock in the twelve months preceding the claim.
BelloStock does not warrant that the Platform will be uninterrupted, error-free or free from viruses or other harmful components. The Platform is provided "as is" and "as available".
BelloStock does not warrant the accuracy, completeness or suitability of any Content for any particular purpose. Buyers are responsible for verifying that Content meets their specific requirements before purchasing a license.
You agree to indemnify, defend and hold harmless BelloStock, its owner, officers, agents and partners from and against any and all claims, liabilities, damages, losses, costs and expenses (including reasonable legal fees) arising from:
BelloStock reserves the right to suspend or terminate any account at any time, with or without notice, for conduct that violates these Terms or that BelloStock determines, in its sole discretion, to be harmful to the Platform, other Users, Contributors, or third parties.
Upon termination of a Contributor account, the Contributor's Content will be unpublished from the Platform. Any pending balance above the minimum payout threshold will be paid out within 30 days of termination, provided no outstanding disputes exist.
Licenses already issued to Buyers at the time of termination remain valid and are not affected by the termination of a Contributor's account.
Users may delete their account at any time by contacting info@bellostock.com.
These Terms are governed by and construed in accordance with the laws of Italy. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Florence (Firenze), Italy, unless mandatory consumer protection laws in your country of residence require otherwise.
For consumers resident in the European Union, the European Commission's Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr.
BelloStock reserves the right to modify these Terms at any time. Material changes will be notified to registered Users via email at least 15 days before coming into effect. The date of the last update is indicated at the top of this document.
Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue using the Platform.
